One of two Etobicoke men charged in an alleged street racing incident has been denied bail; the other will be sent home until his next court date.
A Barrie court judge ruled Saturday 19-year-old Nauman Nusrat be kept behind bars, while 20-year-old Prabjhit Multani was granted bail, but will have to live with his parents under strict conditions.
The two face a number of charges, among them, criminal negligence causing death and causing a common nuisance.
While both men will re-appear in Barrie court July 23, Nusrat will remain incarcerated until he goes to trial, which could be anywhere from a year to two years away.
A judge has to consider a number of factors when deciding whether to grant bail – most notably, flight risk and risk of re-offending. A publication ban remains in place on why the judge granted bail to one, but not the other.
The two are charged in connection with the June 18 death of Innisfil truck driver, David Virgoe, 48, who had to turn his rig to avoid two speeders on Highway 400, and ended up in a ditch.
Families of both accused men were represented at Saturday’s bail hearing, as was the family of the victim.
